By accessing or using Metrical ("the Service") at metrical.digital, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
We may update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
2. Description of service
Metrical provides web performance auditing tools, including Core Web Vitals analysis, performance scoring, and actionable recommendations for improving website speed. The Service is provided on a subscription basis, with a limited free tier available.
We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. Account responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
You must be at least 18 years of age to use the Service. By using Metrical, you confirm that you meet this requirement.
4. Acceptable use
You agree not to use the Service to:
- Scan URLs you do not own or do not have explicit permission to test
- Attempt to overload, disrupt, or attack any systems, including our own
- Circumvent rate limits or access controls
- Resell or redistribute scan results without permission
- Violate any applicable laws or regulations
We reserve the right to terminate accounts that violate these terms without refund.
5. Payment and billing
Paid subscriptions are billed monthly. All prices are as displayed on the pricing page at the time of purchase.
Payments are processed by Stripe. By purchasing a subscription, you authorise Stripe to charge your payment method on a recurring basis.
Refunds: We offer a 14-day money-back guarantee on all paid plans. Contact us at richie@metrical.digital within 14 days of purchase for a full refund.
6. Intellectual property
The Metrical service, including its design, code, and content, is owned by us and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our express written permission.
Your scan results and data remain yours. We claim no ownership over URLs you submit or reports generated from your scans.
7. Disclaimer of warranties
The Service is provided "as is" without warranty of any kind. We do not guarantee that scan results are accurate, complete, or error-free. Performance scores and recommendations are provided for informational purposes only.
We do not warrant that the Service will be uninterrupted, secure, or free from errors or viruses.
8. Limitation of liability
To the fullest extent permitted by law, Metrical shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or loss of business opportunity.
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
9. Termination
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.
We reserve the right to suspend or terminate your account at any time for violation of these terms, with or without notice.
10. Governing law
These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be resolved through good-faith negotiation where possible.
